1. Introduction & Agreement to Terms

Welcome to Pawey. These Terms of Service (“Terms”) govern your access to and use of the Pawey mobile application (“App”), website at pawey.co (“Website”), and all related services (collectively, the “Service”) provided by Trendspark Ltd, a company registered in England and Wales with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom (trading as “Pawey”; “Company,” “we,” “us,” or “our”).

By creating an account, downloading the App, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

We may update these Terms from time to time. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Description of Service

Pawey is a pet health and care companion application designed to help pet owners manage their pets’ health records, schedule reminders for care activities, track weight and vaccinations, find nearby veterinary clinics, and export health timelines. The Service is available on iOS and Android devices.

Pawey is a record-keeping and organizational tool. The Service is not a substitute for professional veterinary advice, diagnosis, or treatment. Always seek the advice of a qualified veterinarian with any questions you may have regarding your pet’s health.

3. User Accounts

3.1 Registration

To use certain features of the Service, you must create an account by providing accurate, current, and complete information. You agree to update your account information promptly to keep it accurate and current.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at hello@pawey.co if you become aware of any unauthorized use of your account or any other security breach.

3.3 Age Requirement

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. We do not knowingly collect personal information from children under 13.

4. Subscription Plans & Billing

4.1 Free Tier

Pawey offers a free tier that includes core features for one pet profile, including health records, weight tracking, vet appointment management, basic reminders, a vet finder, and PDF health timeline export. The free tier is available at no cost indefinitely.

4.2 Premium Subscription

Pawey Premium provides additional features including unlimited pet profiles, unlimited recurring reminders, advanced health analytics, priority support, and early access to new features. Premium subscriptions are billed on a monthly or annual basis as selected at the time of purchase.

4.3 Auto-Renewal

Premium subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. Renewal charges will be applied to the payment method associated with your Apple App Store or Google Play Store account.

4.4 Cancellation

You may cancel your Premium subscription at any time through your device’s app store settings (Apple App Store or Google Play Store). Cancellation will take effect at the end of the current billing period, and you will retain access to Premium features until that date. Pawey does not process subscription payments directly; all billing is managed through the respective app stores.

4.5 Refunds

Refund requests are subject to the refund policies of the Apple App Store or Google Play Store, as applicable. Pawey does not have the ability to issue refunds for purchases made through these platforms. Please contact the relevant app store for refund inquiries.

5. User Content

5.1 Ownership

You retain full ownership of all content you submit, upload, or store through the Service, including but not limited to pet profiles, health records, photographs, notes, and any other data (“User Content”). Pawey does not claim ownership of your User Content.

5.2 License to Pawey

By submitting User Content to the Service, you grant Pawey a limited, non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing, maintaining, and improving the Service. This license terminates when you delete your User Content or your account, subject to reasonable backup and deletion timelines.

5.3 Responsibility

You are solely responsible for your User Content and represent that you have all necessary rights to submit it. You agree not to upload content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.

6. Acceptable Use

You agree to use the Service only for its intended purpose and in compliance with all applicable laws and regulations. You agree not to:

• Use the Service for any unlawful, fraudulent, or malicious purpose
• Attempt to gain unauthorized access to the Service, other user accounts, or any related systems or networks
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
• Scrape, crawl, or use automated means to access or collect data from the Service without our prior written consent
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
• Transmit any viruses, malware, or other harmful code through the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Service to send unsolicited communications or spam
• Sublicense, sell, resell, transfer, or distribute any part of the Service to third parties

7. Intellectual Property

The Service, including the App, Website, and all associated content, features, functionality, design, graphics, logos, trademarks, and software, is owned by Pawey and is protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in the Service or its intellectual property, except for the limited right to use the Service in accordance with these Terms. The Pawey name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pawey. You must not use such marks without our prior written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Pawey is not a veterinary service and does not provide veterinary advice. The information stored and presented through the Service is based solely on data you provide. We do not verify the accuracy of pet health records, and we make no representations or warranties regarding the completeness, accuracy, or reliability of any information available through the Service.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy or completeness of veterinary clinic information provided through the vet finder feature, which relies on third-party data sources.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAWEY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of or inability to use the Service
• Any decisions made or actions taken based on information provided through the Service
• Any unauthorized access to or alteration of your data or transmissions
• Any third-party content or services accessed via the Service
• Any other matter relating to the Service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWEY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO PAWEY IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Termination

10.1 Termination by You

You may stop using the Service and delete your account at any time through the App’s account settings. Upon account deletion, your User Content will be permanently removed from our systems within 30 days, subject to our data retention practices described in our Privacy Policy.

10.2 Termination by Pawey

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or third parties, or is otherwise objectionable. In the event of termination for cause, you will not be entitled to any refund of prepaid subscription fees.

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions) shall survive termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. If we make material changes, we will notify you by posting the updated Terms within the App or on our Website, and by updating the “Last updated” date at the top of this page. We may also send you a notification through the App or via email.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service and delete your account.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts of England and Wales, which shall have exclusive jurisdiction.
